Even before Joe Biden announced in July of 2024 that he would not seek a second White House term, some people were already wondering if the then-chief executive was really in charge. Though elected Democrats and their allies in the establishment media were mostly still claiming Biden was healthy, vigorous, and “sharp as a tack,” it was becoming obvious that all was not well with the nation’s leader. Now, as the Daily Caller exclusively reported on March 5, one state attorney general wants the Justice Department (DOJ) to get to the bottom of who – if not Biden himself – was making the decisions at 1600 Pennsylvania Avenue in the days before Donald Trump took over.
Missouri Attorney General Andrew Bailey wrote a letter to Michael E. Horowitz, the inspector general for the Justice Department, requesting him to “conduct a full investigation into President Biden’s mental capacity in his final days in office.”
Bailey’s primary concern, as he states in his letter, is that, shortly before leaving office, Biden granted a great many pardons or commutations for violent criminals, including “several convicted murderers who committed their crimes in Missouri.” States can file criminal charges against someone even if the individual has already been prosecuted at the federal level. However, a pardon is a pardon. The Missouri AG wants to know whether the former president knowingly granted these pardons. “If in fact Biden’s staffers were exploiting his mental decline, those orders are null and void,” he explained.
The Justice Department and a Can of Worms
Potentially, this opens up a very big can of worms for those staffers and former White House aides, assuming the DOJ’s inspector general doesn’t decline to follow up. How many policy decisions might have been made in Joe Biden’s name but not by the then-president himself? Bailey details one incident where Biden apparently was unaware of what he had signed:
“In January 2024, when [House Speaker Mike] Johnson asked Biden about a moratorium on energy exports to Europe, Biden informed Johnson that he thought he had merely signed an order authorizing a study on exports.”
The letter to Horowitz also notes that White House staffers restricted access to their boss. “Staff limited Biden’s ability to speak with others and limited the sources of information he consumed.” Bailey cites “Democratic lawmakers, donors and aides who worked for Biden and other administrations” who confirmed this tight ring around the president.
