The 8th U.S. Circuit Court of Appeals has temporarily lifted a lower court injunction that restricted Immigration and Customs Enforcement (ICE) agents and other federal officers from using certain tactics against protesters in Minnesota. This decision allows agents to resume full operational flexibility during ongoing immigration enforcement actions in the state while the full appeal proceeds.
U.S. District Judge Katherine Menendez issued the preliminary injunction last Friday, barring federal agents from arresting or detaining individuals engaged in peaceful, non-obstructive protest activity. The order also prohibited the use of pepper spray, tear gas, or similar non-lethal crowd control tools against peaceful demonstrators and observers, as well as stopping vehicles tailing agents unless there was reasonable suspicion of forcible obstruction.
Judge Menendez ruled that these measures addressed a “chilling effect” on First Amendment rights amid heightened tensions in Minneapolis and surrounding areas.
The Trump administration quickly appealed, arguing that the restrictions hampered officers’ ability to protect themselves and the public in volatile situations. On Wednesday, the 8th Circuit granted an administrative stay, pausing the district court’s limits. The appeals court issued a brief, unsigned order siding with the Department of Homeland Security (DHS), allowing ICE and related federal forces to operate without the imposed constraints during review of a potential longer-term stay.
This ruling comes amid Operation Metro Surge, the Trump administration’s major immigration enforcement push in Minnesota’s Twin Cities region. Thousands of federal agents have been deployed since December to conduct deportations and related investigations, drawing sharp criticism from state and local leaders including Governor Tim Walz and Minneapolis Mayor Jacob Frey, who have called the operations an overreach and potential violation of local authority.
Tensions escalated further following the fatal shooting of Renee Nicole Good by an ICE agent earlier this month, which sparked widespread protests and additional lawsuits. Activists filed the original suit in December, claiming federal actions infringed on constitutional protections for monitoring and opposing enforcement efforts.
Attorney General Pam Bondi praised the appeals court decision as a victory for law enforcement, stating it prevents activist judges from undermining federal officers responding to potential interference. The stay provides temporary relief to the administration as it defends its aggressive immigration strategy against multiple legal challenges in the region.
The case highlights ongoing clashes between federal enforcement priorities and state-level resistance. While the injunction is paused, the underlying lawsuit continues, with the 8th Circuit set to consider fuller arguments on whether to maintain or dissolve the restrictions permanently.
